Registration
Registrations for tours, courses and events lasting one or more days can be made in writing, by telephone or by e-mail. The registration is binding and with it the General Terms and Conditions (GTC) of KEEN on Sports GmbH become part of the contract.
Security
KEEN on Sports GmbH is committed to the greatest possible safety on the tour, at events and accompaniment. Activities outdoors and in the mountains always involve certain risks that cannot always be identified in advance despite professional, careful planning, preparation and implementation. By booking, the participant acknowledges these risks and waives any claim for damages and other claims against KEEN on Sports GmbH.
Services
KEEN on Sports GmbH will clearly state in the offer what services are included in the price. All costs not mentioned, in particular travel, food and accommodation costs as well as rental equipment and other additional expenses, are to be paid by the participant.
Prices/Expenses
The prices of KEEN on Sports GmbH are adjusted according to the activity, number of participants and duration of the tour, event or accompaniment. Expenses for arrival and departure, any transfers, food and lodging, for the organisation of rental equipment and other expenses are borne by the participant.
Payment
For individual bookings, payment shall be made in cash before the start of the tour or event or in consultation with the client. The participant will otherwise receive an invoice with the detailed programme (deposit or total amount).
Conditions of participation
Prerequisites are adequate physical and mental fitness for the tour, event, or accompaniment, as well as the appropriate technique (e.g., sure-footedness, freedom from vertigo), experience, equipment, etc. for the chosen activity. The client is obliged to inform KEEN on Sports GmbH of any personal risks (in particular health risks) and to follow its instructions.
If these requirements are not met, KEEN on Sports GmbH is entitled to exclude the participant from the activity or to interrupt the activity without any entitlement to a refund.
Insurance
Insurance cover is the responsibility of the participant. We recommend contract cancellation insurance (also called cancellation costs insurance), health and accident insurance, insurance for search, rescue and repatriation costs in the event of accident or illness, if and insofar as this insurance is not already included in the health and accident insurance policies.
Programme change/Cancellation conditions/Refunds
For weather and safety reasons, there may be changes to the programme, area or tour at any time. This is done in consultation with the participant. The aim is to find an equivalent, feasible tour or activity. Any additional costs shall be borne by the participant.
In the event of insufficient participant numbers or very poor conditions, KEEN on Sports GmbH shall be entitled to withdraw from the contract. In this case or in the event that an event lasting several days has to be terminated prematurely, the participant will receive the value for the service not provided primarily in the form of a credit note, secondarily as a refund.
Cancellation
If a participant cancels their booking, the following costs will be charged:
Up to 31 days before the start of the activity: Free of charge
30 to 21 days before the start of the activity: 50% of the activity costs
20 to 11 days before the start of the activity: 80% of the activity costs
10 to 0 days before the start of the activity: 100% of the activity costs
If KEEN on Sports GmbH incurs external costs, these will be borne by the participant.
Any deviating cancellation conditions will be announced with the offer.
Data protection/image material
KEEN on Sports GmbH uses personal data (name, address, telephone number, e-mail address) for the organization of the tour or event and for sending out newsletters. KEEN on Sports GmbH may forward personal data to all participants, e.g. for the coordination of transfers and photo exchange. If a participant does not agree to the disclosure of their data, they must indicate this in writing when registering.
KEEN on Sports GmbH uses images from tours and events for the keenonsports.ch website, for print products, and on social media. They may not be passed on to third parties without written consent. The participant agrees to the use of the images, unless he/she excludes this in writing when registering.
Place of jurisdiction
Place of jurisdiction is Stans (Nidwalden).
For reasons of legibility, the masculine form has been chosen in the text; nevertheless, the information refers to members of both sexes.
